Jurisdictional Win for Class Action Lawsuits

Firm Litigators Secure Federal Multi-Jurisdictional Transfer and Consolidation of Multiple Pending Lawsuits

In a victory for a firm client that is currently a defendant to four federal court false advertising class actions pending in California, Illinois, Florida and New York, firm litigator Joshua Glikin successfully achieved a nationwide transfer and consolidation of all pending and future cases against this client to the federal court in Maryland where the client is headquartered.

The decision by the seven-judge panel that comprises the United States Judicial Panel on Multidistrict Litigation (“JPML”) will result in a streamlining of all cases that concern the efficacy of several well-known joint health supplements and several products that are sold in the United States and internationally.  The decision saves the expense of defending multiple lawsuits in different federal courts and the possibility that different federal judges would render conflicting decisions on similar issues.  

In a rare move, the JPML agreed with the firm’s request to consolidate the nationwide cases in Maryland, even though no current federal lawsuit had been filed in this state.
