Downsizing in response to the economic downturn? Be sure that your company’s plans comply with the Worker Adjustment and Retraining Notification Act (WARN) which, among other things, requires certain employers to provide notice 60 days in advance of covered plant closings and mass layoffs. Employers that fail to comply with WARN’s notice requirements may be liable to each aggrieved employee for an amount including back pay and benefits for the period of violation, up to 60 days, as well as a civil penalty not to exceed $500 for each day of the violation.
